  • Definition of a contract brewer REVISITED

I recently posted a thread (on 06-28-2010)to get some clarification on the definition of a "contract brewer."

I got a very acceptable answer from jesskidden: "The term "Contract Brewery" unfortunately refers to BOTH parties. Here's the Brewers Association definition, for example: Contract Brewing Company: A business that hires another brewery to produce its beer. It can also be a brewery that hires another brewery to produce additional beer. "

So after further internet readings, I've need some more clarification.

1.) The Contact Brewer(y) who brews actually brews the beer is a fully licensed brewer with either excess capacity
or does this as a full-time profession. Is this correct?

2.) The company who buys the finish product is a licensed beer distributor and can sell the product to other
distributors or to retail stores. Is this correct?

3.) Can the company who buys the finish product be a licensed brewpub?

4.) Can the company who buys the finish product be a licensed brewery who sells the beer via their taproom
    and/or growler sales?

    1) Correct. Very, very few do contract brewing "full time."

    2) Depends on the state. Different states have different laws regrading this, but generally this is correct.

    3) Depends on the state.

    4) Depends on the state.
