  • TTB Filing, DIY vs Attorney

    Hi, first post here, been reading for many months.
    I have a signed LoI to acquire a small local brewery that is in distress. We will not be able to keep the existing brewer's notice due to extenuating circumstances with the current brewery. However, we do have the benefit of their completed/approved application, so have a good jumpstart to content creation.

    We have an attorney representing us for the formation of our LLC and the purchase agreement and we're comfortable with those costs. However, the attorney's flat rate package for managing the TTB process and filing ABC permits is $2500. Trying to conserve precious capital, of course, and we're not sure how reasonable those fees are.

    Having been through the process, have any of you found that you wished you'd had an accomplished attorney steward your application thru the TTB & ABC? Anyone who had an attorney shepherd your application who wishes they would have saved the money and done it themselves?

    Not sure how the state ABC is there, ours was easy, ttb was very easy. Save your money, do it your self. There are a few threads around for all of the various aspects of the TTB forms. We breezed through ours, just make sure you fill everything out, even for the paperwork about water entering navigable waterways and you aren't near one. All you have to do is put "All water processed through municipal sewer system and storm drains are protected from spills by..." and you put in whatever means you are using. It's easy, just make sure you think your answers through, and if you have questions, you can call the TTB, they are very nice.

      We did it all ourselves and it was dead easy. Read the instructions carefully and fill in the necessary info. If you have questions, just give them a call. I found the TTB folks really easy to work with and always ready to help. You sure don't need an attorney to do this unless your time is more valuable doing something else to get the brewery ready.

        We use flat fee with attorney. It was $1000
